This website and SMS tracking service called Findcel (hereinafter the Service) is available to any user for personal use, and subject to the terms and conditions: these Terms of Use and Agreement (hereinafter TUC), our Privacy Policy, and Cookie Policy.
By using the Service, you agree to these TUC and the other terms and conditions.
By doing so, you agree not to use this website for illegal purposes.
3. Service Description
Through the Service, Findcel allows tracking the current location of a person who has consented to be tracked. The Service enables an SMS to be sent to the recipient to inform them that someone wants to know their location. If the message recipient expressly accepts, the recipient's geographic location at that specific moment is shared with the requester.
Under no circumstances should geolocation exceed the specific moment when it was accepted.
The service subscription does not guarantee that the person being sought can be tracked; it only provides the means to do so. However, if the person is missing, has had their phone stolen, has it turned off, or does not accept the link we send via SMS, we will not be able to obtain their GPS position.

However, Findcel does not control these websites or their content, which are actually subject to their own terms and conditions. Therefore, Findcel is NOT responsible for the quality, accuracy, or truthfulness of these websites.
5. Age
Regarding the use of the Service, you declare that you are of legal age and have the legal capacity necessary to be bound by this contract and use it according to its terms and conditions, which you fully understand and acknowledge.
You declare that all information provided to access the Service, before and during its use, is true, complete, and accurate.
6. Intellectual and Industrial Property
The content and information of the Service (including, among others, data, text, audio, image, and computer code), as well as the infrastructure used to provide such content and information, are the property of Findcel or have the corresponding authorizations for their use.
Furthermore, modification, reproduction, duplication, copying, distribution, sale, resale, and other forms of commercial exploitation of the Service are strictly prohibited.
For any other use of the Service's content, our prior written consent is required.

You can contribute to the Service by sending us messages to our email address or through the contact form (hereinafter 'Content').

The prices of plans offered by Findcel are presented in euros (€) and include the value-added tax (VAT) applicable to these services in Spain (21%).
If the customer's place of residence or address is in another member state of the European Union or in a non-EU state, the plan price may change if the applicable tax rate is different.
9. Payment Methods
Payment for the contracted Service can be made:

10. Validity of Offers
The Service offered and the prices of any plans or modalities will be available for purchase as long as they are accessible through this website.

11. Guarantees
All rights granted to you as a consumer and user by current laws are guaranteed.
In any case, although Findcel makes every reasonable commercial effort to provide the Service, you understand that: a) user geolocation requires the express consent of the recipient and; b) even with your consent, the state of technology does not guarantee that your location will always be obtained or that it can be done with sufficient accuracy.
In any case, and to the extent permitted by law, Findcel reserves the right to reject, suspend, or cancel the provision of the Service at its sole discretion.
12. Liability
To use the Service, you confirm that: a) you have legally obtained the phone number you wish to track and with the prior consent of its owner and; b) you do not intend to use the Service for any illegal purpose.
On the other hand, to the extent permitted by applicable law, Findcel will not be liable for any loss of data or programs resulting from the use of the Service.
13. Security
On the other hand, Findcel guarantees the security of the Service according to current technological knowledge.
However, Findcel cannot guarantee complete security of the Service, although it agrees to remedy and implement appropriate corrective measures to address any possible security breach as quickly as possible.
The user agrees to notify the Service immediately and via email to support@mobe-helpcenter.com about any loss of information, unauthorized access or use by third parties, or any situation that may result in the identity theft of other users.
Findcel will not be liable for damages that may occur during the use of the Service if they result from unforeseeable technical problems or, if foreseeable, inevitable. Similarly, Findcel will not be liable when the defective action of the user, whether sender or recipient of the message, causes damages.
14. Subscription and Refund
Access the service through a 24-hour trial period for €0.50, and after this period, if you do not cancel your account, your service subscription is monthly at a rate of €29.90 and will automatically renew for the same period until its conclusion.
Unless you cancel your subscription, you authorize us to charge the corresponding monthly subscription fee to your payment method.
You may cancel your Service subscription at any time, and you will continue to have access to it until the end of your monthly billing period. To the extent permitted by law, payments are non-refundable, and we do not offer refunds or credits for partial monthly subscription periods.
In any case, if you have contracted the Service, the corresponding amount was billed after the initial grace period, but you did not send any messages, you may request a full refund of the charged amount if requested within 14 calendar days from the contract of the Service.

If the credit card with which you registered for the Service does not have sufficient balance at the time of the monthly fee charge, the account will be canceled at that time.
15. Withdrawal
By contracting the Service, you will be contracting the supply of digital content not provided in physical format.
Therefore, and as soon as the content starts to be implemented, you accept and understand that the right of withdrawal, as established in article 103 m) of the General Law for the Defense of Consumers and Users, approved by Royal Legislative Decree 1/2007, of November 16, is not applicable to this contract.
16. Modifications and Nullity
We may update the terms and conditions of the Service in the future, as well as the features and functions of the Service itself.
We will inform you about changes to the terms and conditions by placing a notification in a visible location on our website and/or by email.
If any clause included in our terms and conditions is declared, in whole or in part, null or ineffective, it will only affect the provision in question or the part that is null or ineffective. The rest of our terms and conditions will remain in force, and the provision in question, or the affected part thereof, will be considered excluded.
17. Claims and Actions Arising from the Contract
This service is governed by Spanish law.
In order to simplify the resolution of claims through civil processes and reduce costs, we do not exclude the possibility of submission to a Patrimonial Arbitration of the Arbitration Court of the Chambers of Commerce and Industry.
In this sense, and in accordance with applicable regulations, Findcel informs about the existence of a European online platform for the extrajudicial resolution of disputes that allows the extrajudicial resolution of these disputes for contracts concluded online between consumers and Internet service providers.
